Fully Restoration of DACA

Judge Nicholas G. Garaufits of US District Court in Brooklyn issued an order to fully restore Deferred Action for Childhood Arrivals (DACA) program on Friday (December 4, 2020). Under this order, the Department of Homeland Security (DHS) is instructed to begin accepting new applicants for the DACA as soon as Monday (December 7, 2020).

Judge Garaufits directed the Trump administration to allow newly eligible immigrants to file applications under DACA. He also reversed the memorandum issued by DHS Secretary Chad Wolf on July 28, 2020 due to his lack of legal authority, which cut renewal permit from two years to one and prohibits new applications. The stated order follows a ruling he issued in November that Wolf’s appointment violated the Homeland Security Act of 2002. DHS is ordered to prominently post a public notice no later than Monday that it is accepting new DACA applications. Judge Garaufits instructed officials to grant approved DACA applicants work permits for two years, instead of one year.

DACA is a program created by President Obama in 2012. It is designed to protect undocumented immigrants brought to the US as children from deportation. Applicants are required to arrive the US before 16, live in the US since at least 2007, hold a high school diploma or GED unless they served in the military and have no serious criminal record. According to the report of the New York Times, up to 300,000 additional undocumented immigrants could be eligible for the protection from deportation. This is the first time that DACA is open since 2017.

Trump’s administration could appeal the ruling. On the other hand, President-elect Joseph Biden has promised to restore DACA during his term. Following the court order, Jennifer Molina, a speak person for President-elect Biden made an statement: “Biden will ensure Dreamers and their families have opportunity to live their lives free of fear and continue to contribute to our country.”

美国纽约一联邦法官下令恢复DACA 梦想者计划将重启
