What’s in Biden’s Immigration Reform Bill The US Citizenship Act of 2021
On January 20, 2021, the first day of Biden’s presidency, a Fact Sheet regarding Biden’s Immigration
Reform Bill was released. This article will discuss what is in Biden’s Immigration Reform Bill based on the
information revealed via this Fact Sheet.
First, the US Citizenship Act of 2021 provides an eight-year “earned roadmap” to citizenship for
undocumented individuals who were physically in the US on or before January 1, 2021. Eligible
Dreamers, Temporary Protected Status(TPS) holders and immigrant farmworkers can apply for green
cards immediately. The bill also changes the word “alien” to “noncitizen” in the immigration laws to
recognize the US “as a nation of immigrants”.
Second, to “keep families together”, the bill will clear backlogs, recapture unused visas, eliminate
lengthy wait times, increase per-country visa caps, and eliminate the “3 and 10-year bars.”. It provides
supports to LGBTQ+ families and includes “permanent partnerships”. Applicants with approved family-
sponsorship petitions can wait for green cards in the US on a temporary basis.
Third, the bill makes changes to embrace diversity. It limits future presidents from issuing bans which
are discriminatory based on religion. It increases Diversity Visa to 80,000 and provides new funding to
promote immigrant and refugee integration and citizenship.
Forth, this bill makes significant changes regarding employment-based visas. It will make US university
graduates with advanced STEM easier to stay in the US, improve access to green card to lower-wage
workers, and eliminate unnecessary hurdles for employment-based visas. Specifically, the Fact Sheet
indicates that H1B dependents will have work authorization. It will also strengthen the protection for
noncitizen workers in the US.
Fifth, this bill supports asylum seekers by eliminating the one-year deadline for filing. It also expends the
protection to U, T visa and VAWA applicants. It will protect vulnerable individuals in immigration courts
proceedings and ensue the fair and efficient resolution of the claims.
Biden’s new bill covers “smart border controls” and addresses “root causes of migration” as well. This
Fact Sheet demonstrated that the bill will control the border better, enhance the prosecution for
criminal activities, and a financial assistance plan to certain countries to reduce the causes of people
from fleeing their home countries to the US.
According to this Fact Sheet, this bill had been sent to Congress. It will need to pass the Senate and the
House later. This immigration reform bill makes very broad and significant changes. It will impact a lot of
individuals and businesses if it passed. Attorneys at Law Office of Hong-min Jun are watching closely to
